§1. General Provisions and Definitions

Service: The internet platform operating at the address [Your Domain].

User: Any natural person (Consumer), a natural person conducting business activity (Sole Proprietor with consumer rights), or a legal entity (B2B) using the Services.

AI Models: Combined artificial intelligence technology including the Service Provider's proprietary models and third-party models (e.g., OpenAI, Anthropic, Google – depending on the current configuration).

Limits: Quantitative restrictions within the Subscription Plan (e.g., number of tokens, number of Agent executions, number of active Workflows).

§2. Rules for Providing Services and the AI Act

The Service provides AI tools for process automation (Workflows) and interactive AI Agents.

AI Transparency: In accordance with the AI Act regulation, the Service Provider informs that the content generated within the Service is the result of artificial intelligence. The User is obliged to label AI-generated content if required by the law in their jurisdiction.

Prohibition of Misuse: It is forbidden to use the Service to create unlawful content, generate disinformation, infringe on the personal rights of third parties, or bypass AI model safeguards (so-called "jailbreaking").

§3. Subscriptions, Limits, and Payments (Stripe)

Payments are processed through the Stripe system. Joining a subscription requires providing credit card details or another payment method.

Subscription Model: The subscription is concluded for an indefinite period with monthly or annual payments. Funds are debited automatically at the beginning of each period.

Usage Limits: Each subscription plan has specific Limits. Once a Limit is exhausted, access to certain functionalities (e.g., running a Workflow) is blocked until the subscription renews or additional packages (Top-ups) are purchased. Unused Limits do not carry over to the next billing period unless the plan description states otherwise.

Trial Period (Trial): New Users may be entitled to a free trial period lasting 14 days. Activation of the Trial period occurs automatically upon account creation and does not require providing payment details. Within the Trial period, the User receives access to limited functionalities or Limits as specified in the Pricing. The User may cancel the Service at any time during the Trial period without any costs. In the event of a transition from a Trial plan to a Paid Subscription Plan (via purchase by the User or automatic conversion after 14 days), it is deemed that the User requests the immediate commencement of the full digital service.

The Service Provider reserves the right to change the pricing with 14 days' notice. The change does not apply to already paid periods.

§4. Workflows and Automation

The User configures Workflows (recurring tasks) at their own risk. The Service Provider does not guarantee the execution of a Workflow at an exact second (delays may occur due to server load or external APIs). In the event of errors in an external API (e.g., OpenAI model failure), a Workflow may end with an "Error" status, for which the Service Provider bears no financial responsibility, provided the error was not on their side.

§5. Right of Withdrawal (Important for B2C)

Consumers (B2C): Have the right to withdraw from the contract within 14 days without giving any reason.

Loss of right of withdrawal: In accordance with Art. 38 point 13 of the Act on Consumer Rights, a User who consents to the delivery of digital content (starting the first AI service or Workflow) before the expiry of the 14-day period, loses the right to withdraw from the contract upon the commencement of the service.

Subscriptions can be canceled at any time – they remain active until the end of the paid period.

No right of withdrawal after the Trial period: The User acknowledges that the Trial period serves to familiarize themselves with the Service's functionalities. When the User decides to purchase a Paid Subscription Plan (or does not cancel the subscription before the end of the Trial, provided they provided card details), they express consent to the immediate delivery of full digital content. Due to the nature of the service (AI tools generating results in real-time) and the fact that the User had the opportunity to test the service within the Trial, the right to a 14-day withdrawal from the contract after paying for the subscription is excluded pursuant to Art. 38 point 13 of the Act on Consumer Rights.

§6. Liability and AI "Hallucinations"

The Service Provider applies the highest diligence in maintaining the service but does not guarantee 100% availability (SLA for B2B is governed by a separate agreement, if applicable).

Disclaimer for results: AI may generate substantively incorrect results (hallucinations). The Service Provider is not liable for any damages (including lost profits) resulting from reliance on content generated by AI.

In the case of B2B Users, the Service Provider's liability is limited to the sum of payments made by the User within the last 3 months.

§7. Privacy and Data

Data entered into AI models are processed in accordance with the Privacy Policy. When using external models via API, data is sent to the providers of those models (e.g., OpenAI) solely for the purpose of providing the service. These providers are obliged to maintain confidentiality in accordance with their own DPA (Data Processing Agreements).

§8. Technical Requirements

Internet access, a browser supporting HTML5 and JavaScript standards. Recommended browsers: Chrome, Firefox, Safari in versions from the last 12 months.
